Wills and Small Estate Planning

Why do I need a will?

Many people, especially if they are active and healthy, often think of wills as necessary only for "someone else." But unexpected things happen every day. Taking the simple, proactive step of drawing up a will while you are healthy and thinking clearly could save your loved ones a great deal of time, heartache, and money spent on legal matters if an unforeseen event were to occur.

A will offers the following benefits:

  • Transfer of accumulated assets to your desired beneficiaries - the people you want to receive your assets after your death.
  • It clearly designates a guardian for your minor child or children. In the absence of a will, the Clerk of the Superior Court will have no guidance in selecting a guardian to care for your child.
  • It enables you to specify a Trustee to manage the assets you leave until your child or beneficiary reaches a responsible age.
  • Minimization of federal estate taxes and other costs.

We plan for life's joyous events: the birth of a child, a family wedding, a child's adventure into the college life, or our own retirement. It is only prudent to plan for death as well, easing our loved ones' burden by making our wishes clearly known.

Sehgal Law Firm, P.L.L.C. will prepare a group of documents that make your wishes clear in a situation where you become ill or incapacitated and cannot speak for yourself. This package also includes a will.

During the preparation process, we will sit down together and identify your family's beliefs and goals. Ms. Sehgal will clearly explain the legal procedures and terminology involved, and work with you to formulate a plan to accomplish your goals. Ms. Sehgal will then draft your documents in a professional and confidential manner. Typically, the Estate Planning Package will include:

  • Last Will and Testament
  • Declaration of a Desire for a Natural Death
  • General Power of Attorney
  • Health Care Power of Attorney

Additional documents can also be prepared if more complicated circumstances exist. Whatever your situation or stage of life, Ms. Sehgal will take the appropriate steps to draft legal documents that will protect your goals and interests, as well as the welfare of your family.
